BKX Services and investor David Namdar have accused BitMEX of misappropriating 623 BTC (about $40M), alleging the exchange forcibly liquidated their positions and swept the remaining funds into its insurance fund.

The lawsuit was filed in a New York court on the same day that BitMEX announced its upcoming shutdown.
